What is a Conservator?

A conservatorship must be established through the courts. A conservator is appointed to manage and protect the financial interests of those who are unable to manage and protect them on their own. Individuals who have become incapacitated, are being exploited, or who are otherwise unable to make financial decisions on their own and who have not established a power of attorney, or POA, may require a conservator.

What are the Responsibilities of a Conservator?

The responsibilities of a conservator may include, but are not limited to:

  • Ensuring the conservatee is receiving all the benefits and income to which he or she is entitled
  • Ensuring bills are paid and taxes are filed in a timely manner
  • Advocating for the financial rights of the conservatee
  • Insuring property as needed and maintaining confidentiality
  • Fulfilling any other responsibilities as granted by the court

Who may Serve as a Conservator?

A spouse, partner, adult child, sibling, or other family member or friend may take on a conservatorship, but a loved one may not always be available, able, or willing to take on these added responsibilities.
